General Terms and Conditions of Sale

These General Terms and Conditions of Sale exclusively govern the relationship between Vanessa Mitrani Créations and the Customers wishing to place an order via the website http://shop.vanessamitrani.com. These terms apply to the exclusion of all other conditions.

Article 1. Identification

Vanessa Mitrani Créations is a company involved in the design, manufacturing, and publishing of hand-blown glass items for individuals and professionals. Its range includes vases, bowls, lighting, tableware, and more. This list is not exhaustive.

Vanessa Mitrani Créations is the sole author and manager of all offers and data processing on the above-mentioned website.

Article 2. Acceptance of Terms

You may only place an order if you accept all the provisions stated below.

Every order is governed exclusively by these terms, to the exclusion of any other purchase conditions.
Clicking the "I confirm my order" button after filling your shopping cart constitutes an irrevocable acceptance of these general terms and conditions. This electronic validation is considered equivalent to a handwritten signature.

Article 3. Online Orders

Customers place their orders following the website process. They must provide all necessary delivery details (name, address, access codes, floor, etc.), including a phone number for possible delivery arrangements.

Orders are summarized in a “Order Summary”, indicating the product(s) and pre-shipping total. After selecting the delivery method and payment option (bank card, PayPal, bank transfer), the order is finalized by clicking "I confirm my order."

A confirmation email will be sent. If not received within the expected timeframe, the customer must contact Vanessa Mitrani Créations.

System records from Vanessa Mitrani Créations are considered proof of the order content and date.

Article 4. Order Confirmation

Orders are only considered final after confirmation from Vanessa Mitrani Créations.
Some orders may require additional documentation. In such cases, Vanessa Mitrani Créations reserves the right to cancel the order within 30 days if the requested documents are not received or are deemed non-compliant.

Customers will be informed in the event of stock issues, payment incidents, or unusual order circumstances.

Article 5. Product Availability

Product offers and prices are valid as long as they are displayed online, subject to stock and production availability.

If a product becomes unavailable within 10 days after ordering, the customer will be notified by email or phone.

Article 6. Prices

Prices shown on the site are in Euros (EUR), inclusive of all taxes (TTC), excluding delivery costs, which are detailed during the checkout process.

Vanessa Mitrani Créations may modify prices at any time. The applicable price is the one valid at the order’s registration.

For deliveries within the European Union, prices include French VAT. No additional customs duties or VAT are due. For deliveries outside the EU, the customer is responsible for all duties, taxes, and customs formalities.

Article 7. Payment

  • Cheque (only within France, Monaco, and French Overseas Territories)

No cancellations are accepted unless agreed in writing by Vanessa Mitrani Créations.

Article 8. Invoicing

Invoices can be accessed online via the customer's account.

Article 9. Delivery

Products are delivered to the address provided during the order.

Delivery is made via Chronopost to a designated relay point, where the parcel will be held for 14 days. Unclaimed parcels are returned to Vanessa Mitrani Créations, and redelivery will require payment of new shipping fees.

Orders are usually shipped within 10 days of payment. Delays may occur. If the delay exceeds 10 days, the customer may request a refund.

Vanessa Mitrani Créations is not liable for delays or failure due to force majeure or the carrier.

Upon delivery, acceptance without specific reservation implies the product is received in satisfactory condition.

Damaged product:
Refuse the package and note “Parcel refused – damaged” on the delivery slip and box. Notify Vanessa Mitrani Créations by email, citing the order reference.

Missing product:
Check the delivery slip for the number of parcels. If fewer parcels are received, the delivery may be split. If an item is missing, contact customer service.

Claims must be made within 3 days by registered mail with acknowledgment of receipt. Beyond this period, the delivery is considered accepted.

Article 10. Right of Withdrawal and Returns

According to Article L121-16 of the French Consumer Code, the customer has 7 full days from receipt to withdraw without justification or penalties (excluding shipping and return costs).

Vanessa Mitrani Créations will refund within 30 days of receiving the returned goods. Returns must be in perfect resale condition, with original packaging and accessories.

Return shipping is at the customer's cost and risk. Damaged, used, incomplete, or poorly packaged items will not be refunded or exchanged.

All items are handcrafted, which may result in variations between pieces. Photos on the website are non-contractual. Vanessa Mitrani Créations cannot be held responsible for photographic discrepancies.

Article 13. Retention of Title

Goods remain the property of Vanessa Mitrani Créations until full payment is received.

Article 14. Payment Data Security

Bank details are processed securely by third-party systems (e.g., PayPal) and are never visible to Vanessa Mitrani Créations.

Article 15. Personal Data

Vanessa Mitrani Créations reserves the right to collect user data (e.g., via cookies).

In the event of a dispute, and failing amicable resolution, exclusive jurisdiction is given to the Commercial Court of Bobigny, including in cases involving third-party claims or emergency procedures.
